Official Rules

PARTICIPATION IN THIS CONTEST REQUIRES A CONTESTANT TO HAVE ACESS TO AN INTERNET SERVICE.  PARTICIPATION CONSTITUTES PARTICIPANT’S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL VOID WHERE PROHIBITED.

 

This Contest is sponsored by Consumer Sleep Solutions LLC. (the “Sponsor”), with offices located at 9001 Spectrum Center Blvd, San Diego, CA.

 

I. CONTEST PERIOD: The #DeadTired Photo & Video Contest brought to you by SleepScore Labs (the “Contest” or “Promotion”) begins 09:00 a.m. Eastern Standard Time ("EST"), March 2, 2017 (“Start Date”), and end 11:59 p.m. Eastern Daylight Savings Time (“EDT”), July 31, 2017 (the "Contest Entry Period" or “Contest Period”). The Website server’s clock is the official clock for this Promotion. Participation constitutes a participant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding on all matters related to the Promotion. This Promotion is in no way sponsored, endorsed, or administered by, or associated with, Facebook, Instagram, and Twitter, (“Social Platforms”). You understand that you are providing your information to Sponsor and not to any Social Platforms. This Promotion is subject to the terms and conditions of the above-mentioned Social Platforms. Those who do not follow all of the instructions, provide the required information in their registration form and photo and video submission, or abide by these Official Rules or other instructions of Sponsor may be disqualified.

 

  1. ELIGIBILITY: The Contest is open to a U.S. citizen or a legal resident of the fifty (50) United States and the District of Columbia (“D.C.”) who are thirteen (13) years of age at time of entry. Officers, directors and employees of  Consumer Sleeps Solutions LLC DBA SleepScore Labs and any of their respective parent companies, affiliated companies, subsidiaries, contractors, dealers, franchisees, licensees, distributors, suppliers, participating retailers, advertising / promotion / judging agencies, persons engaged in the development, production or distribution of materials for this Contest, Compliance Sweepstakes Services (the “Contest Administrator”) (collectively, the "Released Entities”), and members of the immediate families (defined for these purposes as including parents, grandparents, children, grandchildren, siblings, and each of their respective spouse) or households (whether related or not) of any of the above, are NOT eligible to enter or win. The Contest is subject to all applicable federal, state, and local laws and regulations and void where prohibited.

 

III. HOW TO PARTICIPATE IN THE CONTEST:

For information about the Contest, a potential Contestant is invited to visit www.Doctoroz.com to learn the different ways to enter view the teaser video link at: https://www.dropbox.com/s/80ufro0ot3tqxw1/F8448%20Resmed%20Brain%20Alive%20V1.12%20%20version%20B.mov?dl=0. When you chose to participate, you are deemed a Contestant (“Contestant” or “you”) and are to create a #DeadTired (“Hashtag”) photo (“Photo”) or video (“Video”) (collectively “Images”) of the funniest, dumbest and even strangest antics you or someone you know have captured while in a state of being dead tired or sleep deprived.  Have fun and be creative with your Photo or Video. The Images can be shot in the moment or may be a staged recreation. This is a Contest that requires skill and entries will be judged based on criteria as specified in Section VII of these rules.

 

A. WAYS TO ENTER:

1.)SleepScore Lab’s Website Method of Entry: When a Contestant has created a #DeadTired (“Hashtag”) Photo or Video and ready to submit, they should go to the How to Submit a Photo or Video Directions link on the SleepScore Lab’s Contest landing page at www.deadtiredcontest.com. (“Contest Landing Page” or “Website”) and follow the prompts to complete the entry form. Upon completion upload the Video or Photo Submission (“Submission”) to the Contest Website. Prior to any public viewing of a Submission, the Sponsor’s judges will moderate the Image content.  Approved Submissions will go to SleepScore Lab’s Gallery (“Gallery”). Only Contestants who entered via the Website will have their Submissions appear in the Sponsor’s Gallery, which can be accessed by using https://deadtiredcontest.us.launchpad6.com/entries.

 

2.) Social Media Platforms: Facebook, Twitter or Instagram Methods of Entry: In each Social Media Platform, Contestants are required to include the tag @mysleepscore (the “username”) and (“Hashtag”) #DeadTired in the description of their uploaded Photo or Video Submission.  By using the Hashtag and the username in connection with a Facebook, Instagram or Twitter Photo or Video upload, Contestant is acknowledging and agrees that they will comply with the Sponsor’s Official Rules and Facebook, Instagram and Twitter’s terms and conditions of use.

 

i)     Facebook Method of Entry:  For a Contestant to submit a Photo or Video, the Contestant must like (“Like”) SleepScore’s Facebook page at https://www.facebook.com/mysleepscore/. Contestant may then post a Photo or upload a Video to their Facebook profile with Hashtag #DeadTired and username @mysleepscore in the description. When entering via Facebook, a Contestant’s profile must be public during the duration of the Contest to be eligible to win. For those who want to view other Contestants’ Submissions in the Sponsor’s Gallery prior to submitting their own Photo or Video, must Like SleepScore Labs’ Facebook page.

 

ii)    Instagram Method of Entry: Contestants are to follow (“follow”) SleepScore @mysleepscore on Instagram and post a Photo or upload their Video using Hashtag #DeadTired and the username @mysleepscore in their Submission description. When entering via Instagram, Contestant’s profile must be public during the duration of the Contest to be eligible to win. For those who want to view other Contestants’ Submissions in the Sponsor’s Gallery prior to submitting their own Photo or Video, must follow SleepScore Labs with username @mysleepscore and the Hashtag #DeadTired on Instagram.

 

iii)  Twitter Method of Entry: Contestant are to follow SleepScore’s Hashtag #DeadTired Photo & Video Contest@mysleepscore and post a Photo or upload a Video on their personal Twitter account using Hashtag #DeadTired, in their Submission description. When entering via Twitter, Contestant’s profile must be public during the duration of the Contest to be eligible to win. For those who want to view other Contestants’ Submissions in the Sponsor’s Gallery prior to submitting their own Photo or Video, must follow SleepScore Labs with username @mysleepscore and the Hashtag #DeadTired on Twitter.

 

B. TO ENTER ADDITIONAL SUBMISSIONS:

Contestants who want to enter additional Photos or Videos Submissions are required to complete the initial entry steps again in any one of, or all Methods of Entry. Up to ten (10) Submissions are allowed. Each must be unique in contest. In the event that two similar Submissions are received, only the entry judged to best meet criteria as set by Sponsor will be included in the final judging. Contestant entering through a Social Media Platform must include the Hashtag #DeadTired and username @mysleepscore in each uploaded Submission description.  

 

The person uploading the Photo or Video Submission will be deemed the Contestant. The Contestant is the one (1) person who owns the email address associated with the Submission. If any group elects to collaborate on a Submission, they are required to designate one (1) person as the agent of the group to enter the Contest, agree to these rules and accept the prize on behalf of the group. Neither Sponsors nor any of the Release Entities are liable for any disputes between collaborators arising under or related to the Contest.

 

This Contest may be cancelled in the event an insufficient number of qualified Submissions are received that meet the minimum standards established by the Judges. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Contestants.

 

IV. TECHNICAL REQUIREMENTS:

                    A. Video Submission: Video files must be no longer than 60 seconds in length; Submission must be primarily in English; Video file size should not exceed 1 GB in file size; Video files must be provided in one of the following file formats: MPEG, .MOV, .AVI, or WMV; Video files must be shot in a horizontal viewing format. Finalists may be asked to provide the original audio and video files used during production of the Submission for broadcast purposes. Upload time may vary depending on file size, Contestant’s service provider, and the volume of Submissions being submitted at any given time. Contestant is responsible for ensuring that his/her Submission is fully uploaded prior to the conclusion of the Contest Period.

B. Photo Submission: Electronic Photo Submission must be shot in a horizontal viewing format; must not exceed 4MB in file size; or 300 dpi at a minimum size of 5 x 3 inches (1,500 x 900 pixels); must be in png, jpeg or jpg file format.

Instructions on how to upload the Photo and or Video is provided in each of the Social Media Platforms.

                

IMPORTANT: Be sure to save your Submission in the original format after uploading it via the Method of Entry. If you are a winner, you will need to provide Sponsor with your Submission in its original format in order for the Submission to be valid. The Sponsor assumes no responsibility for lost, late, misdirected or damaged Submissions, including Submissions that may be delayed in transmission. No incomplete, illegible or otherwise invalid Submissions will be accepted.

 

V. PHOTO OR VIDEO RESTRICTIONS:All Submissions and any parts thereof must be the original work of Contestant and not previously published. Photos and Videos submitted by the Contestant may not contain, as determined by the Sponsor in its sole discretion, any content that is obscene, offensive, sexually explicit or suggestive; violent; derogatory of any ethnic, racial, gender, religious, professional or age group; endorses any form of hate or hate group; profane or pornographic; contains nudity; promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; contains products or trademarks of any Sponsor competitor; defames, misrepresents or contains disparaging remarks about any person or company; contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission, to the extent permission is necessary; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses; contains copyrighted materials owned by others (including, without limitation, photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission, to the extent permission is necessary; contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission, to the extent permission is necessary; contains look-alikes of celebrities or other public or private figures, living or dead; communicates messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate, and/or violates any law or regulation.

 

Submissions must not infringe upon the rights of any person or entity.  If the Photo or Video contains any material or elements that are not owned by the Contestant, and/or which are subject to the rights of third parties (e.g., Photo or Video was taken by someone other than Contestant), the Contestant is responsible for obtaining, prior to entering the Submission, any and all releases and consents necessary to permit the use and exhibition of the Submission by the Sponsor in the manner set forth in these Official Rules, including, without limitation, permission from the photographer to use the Submission and name and likeness permissions from any person (or, if a  minor, his/her parent or legal guardian) who appears in or is identifiable in the Submission. Sponsor reserves the right to request a proof of these permissions in a form acceptable to Sponsor from any Contestant at any time. Failure to provide such proof will render Submission null and void. All submissions become the property of Sponsor and will not be returned.

 

VII. JUDGING AND CONTEST WINNER DETERMINATION AND ODDS: On or about August 10, 2017 eligible Photo and Video Submissions will be reviewed by a panel of judges (“Judges”) selected by Sponsor based on the following weighted criteria on a scale of 1 to 10, with “1” representing the lowest score (“score”) and “10” the highest score: 1) Overall Content Impact and Appeal (defined as: Is the subject in the photo or video interesting to watch and entertaining; 2) Originality and creativity (defined as: An ability to convey relevancy to the #Dead Tired theme; 3) Quality of the video and photo (defined as: Imaging excellence). The Video Submission with the highest score from the Judges using the weighted criteria will determine the Video Grand Prize Winner. The Video Submissions with the next ten (10) highest Judges' scores will determine the ten (10) Video Runners Ups/First Prize Winners. The Photo Submission with the highest score from the Judges using the weighted criteria will determine the Grand Prize Photo Winner. The Photo Submissions with the next ten (10) highest Judges' scores will determine the ten (10) Photo Runners Ups/First Prize.

In the event of a tie, the Submissions will be re-evaluated by a third Judges, using the criteria as stated above. Decision of the judges is final and binding on all matters relating to this contest. By entering this Contest, you agree to abide by the decisions of the judges in relation to this Contest. The odds of winning depend on the number of eligible entries received.

 

Each respective Winner (“Winner(s)”) will be privately notified on or about August 18, 2017. CSS will contact and verify the one (1) potential Video Grand Prize Winner; one (1) potential Photo Grand Prize Winner; ten (10) First Prize Video Winners and ten (10) Photo First Prize Winners. The Video Grand Prize Winner may be announced publicly on a Dr. Oz’s show sometime in October or November 2017.

Winner is subject to verification, including without limitation, verification of eligibility, compliance with these Official Rules and completion of prize release forms.  Upon initial notification and verification of the Winner, confirmation will be sent to the respective Winner in writing via e-mail or other home delivery service of Sponsor’s choice. If a potential Winner cannot be contacted in three (3) days, the Prize will be forfeited and the next potential Winner, based on the next highest scored number will be contacted.

 

VIII. PRIZE (“Prize”): 

• One (1) Grand Prize Video Winner will receive a 2-nights/3-days trip for two (2) to New York City and be an audience member on the Dr. Oz Show, where their Video Submission may be featured. The Grand Prize Package (“Trip Prize Package”) includes round-trip airfare, hotel accommodations and $500 cash for incidentals. Approximate Retail Value (“ARC”) of Travel Package is $3,000.00. The Winner will also receive a S+ Sleep Tracker by ResMed ARV $129.00. Total Approximate Retail Value (“ARV”) of Video Grand Prize is $3,130.00 (USD)

• One (1) Grand Prize Photo Winner will receive $500 and a S+ Sleep Tracker by ResMed. Total ARV $629.99

• Ten (10) First Prize Video Winners will each receive a S+ Sleep Tracker by ResMed. Total ARV $129.99.

• Ten (10) First Prize Photo Winners will each receive a S+ Sleep Tracker by ResMed. Total ARV $120.99.

Total Prize Pool ARV is $4,020.00 (USD)

 

IX. GRAND PRIZE TRAVEL TERMS AND CONDITIONS: Sponsor will provide to the Grand Prize Winner the Prize Package as described in Section VIII. Timing of trip will depend on Dr. Oz’s Show production schedule. Transportation to and from the airport is the responsibility of the Winner. While prize suppliers will make every effort to confirm reservations as requested, operational and/or market conditions may prevent them from doing so on certain requested dates. Blackout periods apply: Accommodations in Manhattan are subject to capacity controls, availability and other restrictions, all of which are subject to change at Sponsor’s sole discretion. Travel may not be combined with any other offer and may not qualify for frequent flyer miles. Sponsor reserves the right, at its sole discretion, to substitute any Prize Package with another prize of equal or greater value in the event that the advertised Prize (or any component thereof) is not available. Winner must execute an Affidavit of Eligibility and Liability/Publicity Release (“Prize Acceptance Release”) prior to issuance of travel documents. Winner and travel companion (hereinafter, “Companion” or “Travel Companion”) must book and travel on the same itinerary. The trip must be completed in October or November 2017 or Prize may be forfeited. Sponsor will not replace any lost, mutilated, or stolen travel vouchers or certificates. The total value of the airfare, accommodations, and Prize Package extras cannot exceed the value of $3,000. The Trip Prize Package cannot be exchanged for cash or other items and is non-transferable. The dollar value difference between the roundtrip air transportation or hotel accommodations will not be provided to the Grand Prize Winner.

 

The Contest Released Entities make no warranty, guarantee or representation of any kind concerning the Prize and disclaim any implied warranty. All expenses not specifically mentioned herein, are not included as part of the Trip Prize Package, and are solely the Winner’s responsibility, including, but not limited to: air carrier or auto lease taxes, additional ground transportation not specified, airline travel insurance, bag check fees, parking fees, laundry service, food, beverages, merchandise, souvenirs, telephone calls, gratuities and service charges, additional site-seeing excursions and any other incidental costs or expenses not identified in these Official Rules.

 

Winner and Travel Companion are also responsible for obtaining airline travel insurance, and all other forms of insurance at the Winner’s option and hereby acknowledge that Sponsor has not and will not obtain or provide any other types of insurance. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the supplier of accommodations, venue operators, transportation companies, prize providers or any other persons providing any prize-related services.

 

Travel Companion of Winner must be at least eighteen (18) years of age as of the arrival date. Once a Travel Companion is selected, he/she may not be substituted, except in Sponsor's sole and absolute discretion. The Travel Companion must execute a Guest liability/publicity releases prior to issuance of travel prize and documents. Travel Companion names and age is required by no later than 30 days prior to the arrival date. No other guests or persons are permitted. If at a time before travel has commenced, the Winner becomes disabled or cannot otherwise fully enjoy the Prize Package due to illness, Sponsor shall be relieved of liability for fulfillment of the Prize award; or (b) at Sponsor's sole and absolute discretion, may award certain Prize components, if available. The Grand Prize Winner must prove such disability by a doctor's certificate, which certificate shall be endorsed by another physician agreeable to Sponsor and Winner at Sponsor's expense.

 

Sponsor maintains no control over the personnel, equipment, or operation of any air carrier, train operator, ground transportation carrier, hotel, or other person or entity furnishing service, products, or accommodations as a part of the Prize provided under this Contest and shall not be liable for any injury, death, damage, loss, expense, accident, delay, cancellation, diversions or substitution, or any act or omission, inconvenience, or other irregularity that may be caused.  Sponsor shall not be liable for any loss or damage to baggage. Winner and Companion will be solely responsible for obtaining valid identification relating to acceptance and use of the travel Prize Packages and the associated costs for these requirements. Prize Packages are subject to any and all restrictions instituted by the Department of Defense and/or Department of Homeland Security, as required at time of travel.

 

X. PRIZE TERMS AND CONDITIONS: All federal, state and local laws and regulations apply. The value of the Video Grand Prize and the Photo Grand Prize may be taxable as income and the potential Winners are solely responsible for all matters relating to the Prizes, including, but not limited to all applicable federal, state and local taxes that become due with respect to the Prizes. Winner of a Prize valued over $600.00 must complete and execute an Affidavit of Eligibility, Publicity/Liability Release (collectively, the “Prize Acceptance Release”) and provide any additional information (such as social security number) that is required by Sponsor and Administrator. Winners will receive an IRS Form 1099 for the value of the Prize they have won. The Prize Acceptance Release must be returned within five (5) days of written notification; otherwise, status as a potential Winner may be forfeited. Falsification of information on forms completed by a Winner will be grounds for ineligibility and/or status/prize forfeiture. Upon forfeiture for any reason stated in these Official Rules, no compensation will be given except at the sole discretion of Sponsor. A Winner is not eligible to receive a Prize until final Video or Photo Submission has been judged as the potential winning Submission in the Contest, and the potential Winner has been verified in accordance with these Official Rules, and the Winner has fully complied with these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Contest. A Grand Prize Winner’s acceptance of the Prize offered constitutes permission (except where prohibited) for the Sponsor to use said Winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation. Winner agrees to be bound by these Official Rules and by the decisions of the Sponsor, which are final and binding in all respects.

 

XI. LIMITATIONS OF LIABLILTY: If for any reason, this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, the Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process (if applicable), and to cancel, terminate, modify or suspend the Contest in whole or in part, at any time, without notice and award the Prize using all non-suspect eligible Submissions received as of the termination/suspension date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor also is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure or delay of any email or Submission to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof. Sponsor is not responsible for any damage to a Contestant’s system, which is occasioned by participating in this Contest or by downloading any information necessary to participate in the promotion. Sponsor also is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error, which may occur in the processing of the entries in the Contest. If any provisions of the Official Contest Rules are determined by a court of competent jurisdiction to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision.

 

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

 

XII. PRIVACY / OPT-IN: By entering the Contest, you hereby authorize the Sponsor the right to collect, use, process, transfer and store all data provided by you, including without limitation, personal data, that the Sponsor deems necessary. All information submitted to the Sponsor as part of this Contest will be treated in accordance with the privacy policy, available at http://www.sleepscorelabs.com/privacy/. You are authorizing the Sponsor to send you e-mails to the address entered on your registration form, regarding services and product offerings. You may opt out of receiving future e-mails from Sponsor by clicking on the link contained in any e-mail received. You will remain eligible for this Contest whether or not you opt out of receiving the e-mails.

 

XIII. LICENSE/USAGE: By providing a Submission, each Contestant grants Sponsor a royalty-free, irrevocable, perpetual license to use, reproduce, modify, publicly perform, distribute, display, publish, create derivative works from, sublicense or otherwise commercially and non-commercially use the Submission in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including but not limited to on any and all Internet media, including the Site, Sponsor’s other web sites and properties and on social networking sites (i.e., Instagram, Facebook, YouTube, Twitter, etc.) and any other third party websites, as well as in any other media, such as banner ads, TV commercials, and billboards, without payment, compensation or further notification to or permission from Contestant, for any legal purpose whatsoever.  Submissions may be cut, edited, reformatted, rearranged, combined with other materials and/or otherwise modified, in Sponsor’s sole and absolute discretion.  In addition, by submitting, Contestants agree to the use of their names, likenesses, biographical information, Submissions and/or statements for purposes of advertising, trade, or promotion without further compensation, unless prohibited by law.

 

XIV. RELEASES: All Contestants, as a condition of participation in the Contest, agree to indemnify, release and hold harmless Released Entities from and all liability, claims, damages, injuries or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) participating in any aspect of the Contest; or (b) the receipt, ownership, possession, use or misuse of any Prize awarded

 

XV. DISPUTES: Except where prohibited, as a condition of participating in this Contest, Contestants agrees that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of, or connected with this Contest, or any prizes awarded, or the determination of Winner shall be resolved individually (without resort to any form of class action and with the understanding and agreement that these Official Contest Rules shall apply), and shall be submitted to arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will Contestant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than Contestant’s actual out-of-pocket expenses (e.g., costs associated with entering this Contest), and Contestant further waives all rights to have damages multiplied or increased. The arbitration shall be conducted in the State of California, in the City of San Diego, County of San Diego, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. In the event that arbitration is prohibited, in a particular state/territory then any such claim shall be brought and maintained in the federal or state courts of the State of California, in the City of San Diego, County of San Diego. Any dispute or claim arising out of the entry of this Contest, or any disputes with site users which arise as a result of the use of this website, shall be governed by the laws of the State of California, without respect to conflicts of laws principles.

 

XVI.
